Florida has many elderly citizens, many nursing homes, and fortunately, one of the strongest laws protecting nursing home residents in the country. Florida laws grant to nursing home residents a long list of rights. Among the most important rights are the right to receive adequate medical care, therapeutic and rehabilitative services, privacy, courtesy, dignity, protection from other residents, and the right to be free from mental or physical abuse.
If a nursing home resident’s rights are violated, the resident or the resident's family or guardian may bring a claim under Florida's nursing home law for actual and punitive damages, and attorney's fees.
