Information About the Florida Birth-Related Neurological Injury Compensation Plan (NICA)
This birth injury NICA web site is intended to provide information to parents and other lawyers about the Florida Birth Related Neurological Injury Compensation Plan, sometimes referred to as the NICA Program. We are not the official NICA agency. We are a private law firm and we believe people whose lives may be impacted by NICA should have a better understanding of how the program works. We can also help you decide whether to seek the benefits of the program or instead, attempt to avoid the program and bring a medical malpractice case to recover damages.
There is no cost to retain us for your NICA claim. If we represent you, our attorney fees and expenses are paid by NICA when your child is accepted into the program. If your child is not accepted, you still owe us nothing for attorney’s fees or expenses. If your child and family are denied NICA benefits, you may be eligible to file a medical malpractice case and recover substantial damages from that type of claim. We can help you with that too.
If you are trying to determine if your child is eligible, please fill out our “Is My Child Covered?” form and we will give you free advice about your child’s eligibility.
If you are the parent of a birth-injured child looking for information about the NICA program we suggest you begin by reviewing the section on this site for “Frequently Asked Questions”. If there are any additional questions that are not covered there, we are easy to talk to and would be happy to anwer any questions you have.
We handle malpractice cases throughout Florida. While our firm started in Orlando and our main office is still there, in order to serve our statewide clients better we also maintain locations in several major cities to make it easier for us to handle cases statewide, and easier for you to consult with us for your case. In some geographic areas, we may also associate with another local law firm to serve you better. Any such association would be at no additional attorney fees or expenses charged to you.
