Under § 2678, attorneys may not charge a contingency fee of more than 20% of the recovery if the recovery is made before the suit is filed in Court. If suit must be filed to obtain the recovery the attorney fee goes to 25%, whether it is a settlement before trial or a judgment after a trial.
