NICA is a birth injury program created by the Florida legislature in 1988 and it is still effective today. The initials “NICA” are sometimes used to refer to the “Neurological Injury Compensation Act,” and sometimes used to refer to the “Neurological Injury Compensation Association,” which is the quasi-state agency created to administer the NICA program.
The idea behind the program is that if newborn babies sustain substantial brain injuries during birth, or shortly thereafter, the baby and parents can recover certain no-fault benefits by filing a claim with the NICA program. NICA claims and obtaining NICA benefits are in lieu of filing a medical malpractice law suit.
